These Terms and Conditions ("Terms") are the agreement between you and [Registered company name] (company number [Company registration number]), registered at [Registered office address], trading as Mometrix ("we", "us", "our"), for your use of www.mometrix.com and everything we sell through it.
Please read them before you buy. Placing an order means you accept these Terms. If you do not accept them, do not use the site.
Two things we want to be clear about at the top:
- We sell exam preparation material. We do not sell certifications, and we are not affiliated with, endorsed by, or licensed by any certification vendor or test provider. See What we sell.
- If you are a consumer in the EU or the UK, nothing in these Terms takes away your statutory rights. Where a clause here conflicts with a right you have by law, the law wins. The clauses that matter most to you are Right of withdrawal, Statutory conformity rights, and Liability.

Who may use the site
You may use the site and buy from us if you are at least 18 years old, or the age of majority where you live if that is higher, and you can enter into a binding contract. If you are buying for an organisation, you confirm you are authorised to bind it, and "you" then means both you and that organisation.
What we sell, and what we do not
We sell. Exam preparation material for third party IT and professional certification exams, in these formats:
- PDF question sets: question and answer files you download and read on any device.
- Web based practice tests: a browser based practice engine you use while signed in to your account.
- Desktop practice test software: a Windows application that requires the .NET Framework, activated with a licence key.
- Bundles and packages: combinations of the above, and multi exam access plans, sold on the terms shown on the relevant product page.
We do not sell, provide, award, or arrange certifications. To sit an exam and become certified you must register with the certification body or an authorised test provider such as Pearson VUE or Prometric. We have no role in that process, no influence over it, and no ability to change a result.
We are independent. Vendor names, exam codes, and trademarks are used only to identify the exam a product prepares you for, which is nominative fair use. We are not affiliated with, sponsored by, endorsed by, or authorised by any of those vendors, and no such relationship should be inferred from anything on this site.
Content accuracy. We work to keep our material accurate and current, but exams change, and we do not warrant that any product is complete, error free, or matches the live exam at any given moment. This does not affect your statutory conformity rights. If you find an error, tell us at support@mometrix.com with a screenshot and we will correct it and reissue the product.
Try before you buy. Free demos are available for our products. We recommend using them. They are the best way to check that the format and the material suit you before you spend anything.
Your account
You need an account to buy and to download.
- Give accurate registration details and keep them up to date.
- Keep your password confidential. The account is personal to you. You are responsible for everything done under it.
- Tell us at once at support@mometrix.com if you suspect unauthorised access.
- We may suspend or close an account that has been used in breach of these Terms. Where the breach is not serious, we will warn you first and give you a chance to put it right.
Sharing account credentials so that other people can use your entitlements is a material breach. See Acceptable use.
Orders, prices, and payment
How the contract forms. Products listed on the site are an invitation to treat, not an offer. Your order is an offer to buy. The contract forms when we send you an order confirmation email, or when we make the product available in your member area, whichever happens first. If we cannot accept your order we will tell you and refund any payment in full.
Prices. Prices are shown on the product page in the currency displayed at checkout. We may change prices at any time, but a change never affects an order we have already confirmed.
Tax. Where an order is processed by FastSpring, FastSpring is the merchant of record: it is the seller for that transaction, it calculates and charges any VAT, GST, or sales tax due in your country, and it issues the invoice. The tax treatment shown at checkout is final. EU and UK consumers are shown prices inclusive of the VAT that applies to them before they commit to pay, as consumer law requires.
Payment. We accept the payment methods shown at checkout, including major credit and debit cards and PayPal where offered. Payment is taken in full at the time of order. We do not store your card details; see the Privacy Policy.
Errors. If a product is listed at an obviously incorrect price because of a typographical or system error, and the error should reasonably have been apparent to you, we may cancel the order and refund you in full rather than supply at that price.
Discounts. Coupon and bundle discounts apply as stated at the time of use, cannot be combined unless we say so, and have no cash value. Note that products bought at a heavily reduced price or obtained free are excluded from the pass guarantee; see Refunds.
Fraud. We may cancel an order, withhold delivery, or suspend an account where we reasonably suspect fraud, chargeback abuse, or a stolen payment instrument. You agree to cooperate with any resulting investigation.
Delivery and access
Delivery is electronic. There is nothing to ship.
- On confirmation of payment, the product appears in your member area for download, or your web based practice test becomes accessible, normally immediately and in any event without undue delay.
- Desktop software is delivered as a download plus a licence key.
- If a product does not appear, contact support@mometrix.com and we will resolve it.
Entitlement period. Unless the product page says otherwise, a purchase includes 90 days of support and free product updates from the date of purchase. During that period, updated versions appear in your member area at no extra cost. Longer entitlement periods, up to 12 months, may be offered at purchase. When an entitlement period ends, updates and support stop, and desktop activations tied to that entitlement are deactivated. You may renew on the terms shown in your member area.
System requirements. PDFs work on any device with a PDF reader. The web based practice test runs in current browsers and needs a screen of about 7 inches or larger. The desktop practice test software requires Windows with the .NET Framework and does not run on macOS, Linux, or server editions. Check these before buying: a product that will not run on hardware it never claimed to support is not a defect, though it may still be within your withdrawal right if you have not started the download.
Your licence
On payment, we grant you a limited, personal, non exclusive, non transferable, non sublicensable licence to download, install where applicable, and use the product for your own preparation, for the entitlement period and, for files already downloaded, thereafter for personal reference.
Unless the product page expressly says otherwise:
- one licence is for one person,
- a desktop licence key may be activated on up to two devices belonging to that person,
- corporate and trainer licences are sold separately, on the terms of that offer, and permit the number of named users stated there.
Fair use on multi exam and unlimited plans. Access plans are for individual study, not bulk acquisition. Unless your plan page states different figures, downloads are limited to 5 files per day and 20 files per month, and unlimited access plans to 10 exams per week. Downloading through multiple unrelated geographic IP addresses is treated as sharing and may result in suspension.
We retain all ownership of the products. You get a licence, not a sale of the underlying rights.
Acceptable use
You must not, and must not help anyone else to:
- copy, reproduce, republish, upload, post, transmit, resell, rent, lend, or otherwise distribute any product or part of it, in any medium,
- share your account, licence key, or downloads with anyone else,
- remove, obscure, or alter any copyright notice, watermark, or licence identifier,
- reverse engineer, decompile, or disassemble our software except to the extent that applicable law expressly permits despite this restriction, including the decompilation right under Article 6 of Directive 2009/24/EC where its conditions are met,
- circumvent, disable, or interfere with any security, access control, or usage limiting feature,
- scrape, crawl, harvest, or use any robot, spider, or automated means to extract questions, listings, descriptions, prices, or any other content,
- use data mining or bulk extraction tools against the site,
- frame the site, or use our name, logo, or trademarks in metadata, hidden text, or advertising without our written consent,
- probe, scan, or test the vulnerability of the site, or breach or attempt to breach its security,
- interfere with the site's operation, or place an unreasonable load on it,
- use any product or the site for anything unlawful, or in breach of any exam body's own rules.
Consequences. Breach may lead to suspension or termination without refund, revocation of licence keys, and legal action. Because unauthorised copying causes harm that is hard to quantify, we may seek an injunction in addition to any other remedy.
User content, comments, and discussions
You may post comments, questions, replies, and other content in the community areas.
Your responsibility. You keep ownership of what you post. You confirm that you own it or have the right to post it, that it is accurate, and that it does not infringe anyone's rights.
What you may not post. Anything unlawful, infringing, defamatory, obscene, threatening, harassing, hateful, or invasive of privacy; personal data about other people; malware; spam, chain messages, or commercial solicitation; actual exam content obtained under a non disclosure agreement with an exam body; or anything posted under a false identity.
Licence to us. By posting, you grant us a non exclusive, royalty free, worldwide, sublicensable licence to host, store, reproduce, adapt, publish, translate, and display that content in connection with operating and promoting the service, for as long as you keep it posted and for a reasonable period afterwards to the extent needed for backups and for content already distributed. You also permit us to show the display name you posted under alongside it. This licence ends when you delete the content, save for those residual uses.
Moderation. We may remove or edit content and suspend accounts, but we are under no general obligation to monitor, and we do not pre screen. Where we remove your content or restrict your account, we will tell you the reason and how to challenge it, as required by Article 17 of the EU Digital Services Act where it applies to us.
Copyright complaints. See the DMCA page, or write to sales@mometrix.com. We operate a notice and takedown process and terminate the accounts of repeat infringers.
Your right of withdrawal (EU and UK consumers)
If you are a consumer in the EU, you have a right of withdrawal under Directive 2011/83/EU. If you are a consumer in the UK, you have an equivalent right under the Consumer Contracts (Information, Cancellation and Additional Charges) Regulations 2013. This section explains it, and explains how you can lose it.
The right
You may withdraw from a purchase within 14 days, without giving any reason. The period runs from the day the contract is concluded, which for digital content is the day of your order confirmation.
How to withdraw
Tell us clearly before the 14 days are up. Email support@mometrix.com with your order number and a statement that you are withdrawing, or use the contact form. You may use the model withdrawal form below, but you do not have to. Sending the notice before the deadline is enough; it does not need to reach us before then.

Effect
We refund all payments received from you within 14 days of being informed, using the same means of payment you used, at no cost to you.
When the right is lost
For digital content that is not supplied on a physical medium, the right of withdrawal is lost once performance has begun, provided that you gave express prior consent to immediate performance and acknowledged that you thereby lose the right, and that we confirmed the contract to you on a durable medium.
All three of those conditions must be met. Consent must be express and specific, given by you at checkout as a separate, active step. It is not enough that these Terms describe the rule, and it is not enough that you ticked a general "I accept the terms" box.
So, in plain terms: unless you were expressly asked at checkout to consent to immediate access and to acknowledge the loss of your withdrawal right, your 14 day right survives the download, and you may withdraw and be refunded in full within that period. Where you were asked and did consent, the right ends as soon as the download or the practice test starts.
Either way, if you have not started, the right is intact and you get a full refund on request, with no reason needed.
This is separate from, and additional to, our own pass guarantee, which is a contractual promise we make voluntarily and which does not limit your statutory rights.
Statutory conformity rights
If you are a consumer in the EU, Directive (EU) 2019/770 on digital content and digital services gives you rights if what we supply does not conform to the contract. UK consumers have equivalent rights under the Consumer Rights Act 2015. Nothing in these Terms excludes or limits them.
The product must match its description, be fit for the purposes such products are normally used for, be supplied with the updates the contract provides for, and be of the quality and performance you can reasonably expect.
If it does not, you are entitled to have it brought into conformity free of charge and without significant inconvenience, and, where that is impossible, disproportionate, not done within a reasonable time, or where the lack of conformity is serious, to a proportionate price reduction or termination of the contract with a refund.
For digital content supplied as a single act of supply, these rights apply to a lack of conformity that becomes apparent within two years of supply. For content supplied continuously, they apply throughout the supply period. In the EU, a lack of conformity appearing within one year of supply is presumed to have existed at the time of supply, and we carry the burden of proving otherwise.
To claim, write to support@mometrix.com describing what is wrong. There is no charge for making a claim.
Refunds and the pass guarantee
Beyond your statutory rights, we offer a voluntary pass guarantee. The full conditions are on the Refund Policy page and form part of these Terms. In summary: if you prepare with our product and fail the exam, we refund you or swap the product, subject to the conditions there, which include evidence of enrolment and of the result, a purchase within the last 90 days, a genuine preparation period, and exclusions for non proctored exams, retired exams, certain vendors, bundles, and heavily discounted or free products.
Approved refunds are paid within 7 business days of approval, to the original payment method.
Order of precedence. If you have a statutory right to a remedy, that right applies regardless of whether a guarantee condition is met. The guarantee adds to your rights; it never replaces them.
Availability, changes, and suspension
We aim to keep the site available, but we do not guarantee uninterrupted access. We may suspend, withdraw, or restrict all or part of the site for maintenance, security, or business reasons. Where we can give notice, we will.
We may change a product to keep it working, to reflect a changed exam, or to comply with the law. Where a change materially and negatively affects your use of digital content supplied over a period, and the contract permits the change, we will tell you a reasonable time in advance on a durable medium, and you may terminate free of charge within 30 days, as Article 19 of Directive (EU) 2019/770 provides.
Disclaimers
To the fullest extent permitted by law, and without affecting the statutory rights of consumers:
- the site and its content are provided "as is" and "as available",
- we do not warrant that use of our products will result in your passing any exam, obtaining any certification, or achieving any particular score,
- we do not warrant that the site will be uninterrupted, timely, secure, or free of errors or harmful components,
- we make no representation about third party sites we link to, and we are not responsible for their content, products, or practices.
Consumers: these disclaimers do not exclude any warranty or right implied by law that cannot lawfully be excluded, and in particular do not affect the conformity rights set out above.
Our liability
Nothing in these Terms limits or excludes our liability for:
- death or personal injury caused by our negligence,
- fraud or fraudulent misrepresentation,
- any other liability that cannot be limited or excluded under the law that applies to you.
If you are a consumer, we are liable for loss or damage you suffer that is a foreseeable result of our breach or our failure to use reasonable care and skill. We are not liable for loss or damage that is not foreseeable. We are not liable for business losses, because our products are supplied for personal study; if you use them for business, the business clause below applies.
If you are a business, then to the fullest extent permitted by law: we exclude all implied terms, conditions, and warranties; we are not liable for loss of profit, revenue, business, contracts, goodwill, anticipated savings, data, or for any indirect or consequential loss; and our total liability arising out of or in connection with the contract, whether in contract, tort (including negligence), breach of statutory duty, or otherwise, is limited to the amount you paid us for the product giving rise to the claim in the 12 months before the claim arose.
Indemnity (business users only)
If you use the site or our products other than as a consumer, you will indemnify us against claims, losses, and reasonable costs, including legal fees, arising from your breach of these Terms, your misuse of the products, your infringement of a third party's rights, or content you post. This clause does not apply to consumers.
Force majeure
Neither party is liable for a failure or delay in performing an obligation caused by an event beyond its reasonable control, including acts of God, war, civil unrest, terrorism, epidemic, industrial action, failure of utilities or telecommunications, or acts of government. This does not affect your right to a refund for something we do not deliver.
Term and termination
These Terms apply for as long as you use the site.
You may stop using the site at any time and may ask us to close your account by writing to support@mometrix.com. Closing the account ends access to your downloads and entitlements.
We may suspend or terminate your access if you materially breach these Terms, if we are required to by law, or if we reasonably suspect fraud or licence abuse. Except where the breach is serious or the law requires immediate action, we will give notice, state the reason, and allow a reasonable opportunity to remedy. Where we terminate for a reason that is not your fault, we will refund the unused portion of any period based entitlement.
Termination does not affect rights that accrued before it, nor the clauses that by their nature survive: licence restrictions, acceptable use, user content licence, disclaimers, liability, indemnity, and governing law.
Notices
You agree to receive notices from us by email to the address on your account, by post to the address you gave us, or by posting them on the site. A notice posted on the site is treated as received 24 hours after posting; sent by email, on sending, unless we are told it was not delivered; sent by post, 3 business days after posting.

Changes to these Terms
We may change these Terms.
- The version in force is the one published on this page, with the effective date shown at the top.
- We will give reasonable advance notice of any material change by posting a notice on the site and, where we hold your email address and the change is significant, by email.
- Changes never apply retrospectively to an order already confirmed.
- If you do not accept a change, stop using the site and, where a period based entitlement is affected, tell us and we will refund the unused portion.
Governing law and disputes
These Terms and any dispute arising out of them are governed by the laws of England and Wales, and the parties submit to the exclusive jurisdiction of the courts of England and Wales.
If you are a consumer, that is subject to two important carve outs, and they are not waivable:
- Article 6(2) of Regulation (EC) No 593/2008 (Rome I). Choosing the laws of England and Wales cannot deprive you of the protection of the mandatory consumer law of the country where you habitually reside. Those protections continue to apply to you.
- Article 18 of Regulation (EU) No 1215/2012 (Brussels Ia), and the equivalent UK rules. You may bring proceedings against us either in the courts of England and Wales or in the courts of the country where you are domiciled, and we may bring proceedings against you only in the courts of the country where you are domiciled.
Complaints first, please. Write to support@mometrix.com. We aim to acknowledge within 2 business days and to resolve within 14 days.
Alternative dispute resolution. EU consumers may be entitled to use an alternative dispute resolution body under Directive 2013/11/EU. Your national European Consumer Centre can tell you which body covers a trader in our sector, and can help with a cross border complaint. Please note that the European Commission's Online Dispute Resolution platform ceased operating on 20 July 2025, so it is no longer a route. We are not currently signed up to a specific ADR scheme, and we are not obliged to be, but we will consider in good faith any ADR proposal you make.
The rest
Severability. If a court finds any provision invalid or unenforceable, it is modified to the minimum extent needed to make it enforceable, or struck out if that is not possible. The rest stands.
No waiver. If we do not enforce a provision, that is not a waiver of it, and we may enforce it later.
Assignment. You may not transfer your rights or obligations without our written consent. We may assign or transfer ours to a successor in business, provided your rights under these Terms are not reduced.
No third party rights. No one other than you and us has any right to enforce these Terms.
Entire agreement. These Terms, together with the Privacy Policy, the Refund Policy, the DMCA page, and the terms shown on the relevant product page, are the whole agreement between us about their subject matter, and replace any earlier statement or understanding. Nothing here excludes liability for fraudulent misrepresentation.
Language. These Terms are concluded in English. A translation, if provided, is for convenience, and the English version prevails to the extent the law of your country permits.
